Creativity Jungle Beta Testing Agreement — version 1.0
The short version, so you know what you are agreeing to. It is not the agreement
itself — the numbered terms below are what govern.
- You get early access to something unfinished. Don't share it.
- Tell us what you think. We can use your feedback freely, and we won't
pay you for it.
- Anything you create with the software stays yours.
- It will break. Don't trust it with anything you can't afford to lose.
- Other testers on this project see your feedback, shown as your first name and last
initial — so don't put anything private in a feedback post.
- Either of us can walk away at any time.
1. Who this is between
This agreement is between Creativity Jungle LLC ("Creativity Jungle", "we",
"us") and the person accepting it ("you", "Tester"). It applies separately to each project you
are accepted for.
2. Definitions
- Project — a specific Creativity Jungle product you are accepted
to test.
- Pre-Release Software — any build, installer, hosted environment,
prototype, asset or documentation we provide for a Project.
- Confidential Information — the Pre-Release Software and anything
non-public you learn here: unreleased features, roadmaps, designs, screenshots, defects,
pricing, test credentials, and the contents of the feedback board.
- Feedback — anything you tell us about a Project.
- Your Content — material you create, upload or import while using
the Pre-Release Software.
3. Eligibility
You confirm that you are at least the minimum age stated for this Project and in any case
at least 13; that you can enter a binding agreement where you live, or have a parent or
guardian accepting on your behalf; that your application was accurate; and that you are not
accepting on behalf of a competitor to gain commercial advantage.
4. What we give you, and what you may do with it
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use
the Pre-Release Software solely to test it and give us Feedback, for as long as you remain an
active tester on this Project.
You may not:
- share, publish, sell, sublicense, lend or distribute it, or give anyone access to your
account;
- post screenshots, recordings, streams or descriptions of unreleased features publicly,
including on social media, forums, or to the press;
- reverse engineer, decompile or disassemble it, except where the law expressly permits
this despite a contractual restriction;
- remove or obscure any notice of ownership;
- use it in live production, for paying clients, or for anything safety-critical; or
- probe, scan, load-test or attack our systems, or attempt to reach data that is not
yours.
Found a security vulnerability? Report it privately to
support@creativityjungle.com and give us a
reasonable opportunity to fix it before telling anyone else.
5. Confidentiality
Keep Confidential Information confidential. Do not disclose it outside the programme, and
do not use it for anything except testing and giving Feedback.
This does not cover information that is or becomes public through no fault of yours; that
you already knew free of any duty of confidence; that you developed independently without
using ours; or that you are legally compelled to disclose — in which case tell us first
if you lawfully can.
How long: until this Project is publicly released, or two (2) years from
the date you accept, whichever comes first.
6. Feedback
- You grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable licence to
use, copy, modify and incorporate your Feedback into any product, with no obligation to
credit, compensate or notify you.
- You waive any claim to payment, royalties or ownership arising from our use of it.
- We are under no obligation to act on any Feedback or implement any suggestion.
- Do not submit Feedback that is someone else's confidential information.
Other testers can see your Feedback. It is visible to the other approved
testers on this Project, so they can see what has already been reported. Your identity is
shown to them as your first name and last initial — never your full
name, email address, phone number or location. Our team can always see who filed what.
Because other people will read it: do not put confidential, personal or sensitive
information into a feedback post, title, or linked screenshot. Email us instead.
7. Your Content stays yours
We claim no ownership of Your Content. Your manuscripts, questions, records and anything
else you make with, or put into, the Pre-Release Software remain yours. You grant us only the
narrow, temporary licence needed to host, process and display it so the software works, and to
diagnose a problem you have reported. We will not use Your Content to promote our products
without asking you first.
Keep your own backups.
8. Your account
We create your account when we accept your application; you will receive a temporary
password and must set your own on first sign-in. Your account is yours alone — do not
share it. Tell us promptly at
support@creativityjungle.com if you believe
it has been compromised. You are responsible for activity under your account.
9. No warranty
The Pre-Release Software is unfinished and provided "as is". Expect
defects, unpredictable behaviour, changes without notice, and withdrawal at any time.
To the fullest extent the law allows, we disclaim all warranties, express or implied,
including merchantability, fitness for a particular purpose, non-infringement, and any
warranty of accuracy, availability or data preservation.
Do not use it for anything you cannot afford to lose.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special,
consequential or punitive damages, or for lost profits, revenue, data, goodwill, or the cost of
substitute software — even if advised such damage was possible. Our total liability
arising out of the programme will not exceed one hundred US dollars (US$100).
Nothing here excludes liability that cannot lawfully be excluded, including for death or
personal injury caused by negligence, or for fraud.
11. No payment, no employment
Participation is voluntary and unpaid. You are not our employee, contractor, agent or
partner. You are not entitled to payment, equity, a free or discounted licence, or other
compensation, unless we agree otherwise separately in writing.
12. Privacy and your data
What we collect: your name, email address, phone number (if given), city,
state and country, date of birth, your answers to this Project's application questions, and the
IP address and browser the application was submitted from. As a tester we also hold your
Feedback, comments, votes and sign-in timestamps.
Why: to decide on your application, run the programme, contact you about
it, act on your Feedback, and record which version of this agreement you accepted.
Who sees it: our team sees all of it. Other testers see only your first
name and last initial, and only alongside Feedback you have posted. We do not sell your data,
and share it only with service providers who help us operate the site, under obligations of
confidentiality.
Your choices: you can turn off notification emails in your account settings
— account emails such as password resets still send. You can ask us to correct or delete
your personal information at any time by emailing
support@creativityjungle.com.
13. Term and termination
You may leave a Project at any time. We may suspend or end your access at any time, with or
without reason — including if you breach this agreement, or simply because a testing
round has closed. On termination you must stop using the Pre-Release Software and, if asked,
delete or return any copies.
Sections 5 (for its stated period), 6, 7, 9, 10, 11 and 14 survive termination.
14. General
- Changes. Material changes receive a new version number, and we will ask
you to accept the new version before continuing. Your recorded acceptance always names
the version you saw.
- Entire agreement. This replaces any earlier understanding about the beta
programme.
- Severability. If any part is unenforceable, the rest stays in force.
- No waiver. Not enforcing something immediately does not give up the
right to enforce it later.
- Assignment. You may not transfer this agreement; we may transfer it to a
successor of our business.
- Governing law. The laws of the State of Kansas, United States of America,
without regard to conflict-of-laws rules. The state and federal courts
located in Olathe, Kansas have exclusive jurisdiction.
